What to include in a lease termination letter

  • Every tenant's name as it appears on the lease, and the full address with unit number
  • The exact date the tenancy ends, and the date of the letter so the notice period is clear
  • For tenants: a forwarding address for the security deposit and a request for a move-out inspection
  • For early termination: the lease end date, the reason, and what you offer, such as a fee or a replacement tenant
  • A signature and a phone number or email for questions

Month-to-month vs. fixed-term leases

A month-to-month tenancy can be ended by either side with written notice, usually 30 days and often timed to end on the last day of a rental period. Some states require more, such as 60 or 90 days when a landlord ends a long tenancy, and some cities limit the reasons a landlord can use.

A fixed-term lease ends on its end date, but many leases require notice that you won't renew, and some roll over to month-to-month or renew automatically without it. Ending a fixed-term lease early needs the landlord's agreement, a clause in the lease, or a legal right such as the Servicemembers Civil Relief Act.
